In order to enforce the law, some people are given legal power. The courtroom is a place where the use of power is clearly demonstrated. As different courtroom actors play different roles, power is not equally distributed among them. Besides, due to the long history of our legal system, the court is a ritualised space involving a lot of traditional elements and all these elements symbolise power. For example, the judge’s bench is always at a particularly higher level, meaning that the judge holds the ultimate authority. Behind the judge’s bench is the coat of arms of Australia, which symbolises that the judge is appointed to represent the Commonwealth. Therefore, it is not difficult to discover the presence of power disparity if we spend some time observing in a courtroom. Using participant observation as the basic method of gathering data, this article aims to analyse the operations of the court and the power relations between courtroom actors in a courtroom, and to discover whether justice is really served by the court. The observation of court proceedings is carried out in the Local Courts on Levels 4 and 5, Sydney Downing Centre. Judges and Sentencing In accordance with Smith and Natalier (2005: 121), traditional legal concept suggests that judges’ and magistrates’ responsibility is to apply legal principles in a rational and objective way; each party tells their own story, and then the judge, or the jury (if applicable) determines which version is true, on the basis of evidence. Whilst in most of the ‘dailyâ₠¬â„¢ criminal cases there are no juries, such that the outcome of a case is solely the judge’s decision. While we may think that evidences always reveal the truth, in some circumstances there are not any solid evidences such as seized exhibits and surveillance camera recordings, nor any third person individuals who have witnessed the happening of the crime. The whole case simply relies on the statements provided by parties involved, or the testimony of the victim in the crime. As a consequence, the judge has control over the outcome of the case to a very large extent. In one of them, the only evidence was a self incriminating statement made to the police by the defendant, in which the defendant admitted that he had committed the crime. The defense counsel, however, claimed that the statement was made under duress and sustained pressure, and therefore he asked for the exclusion of such evidence. The magistrate ruled in favour of the defendant after the ‘voir dire’ procedure. From the above, it is observed that while judges exercise their greatest power in deciding whether the prosecution’s or the defendant’s version is true, many factors are taken into account in order to protect the rights of the accused. On the other hand, there are exceptional cases. In another court proceeding observed, the magistrate suggested that the defendant’s statement was highly unreliable, and he pointed an accusing finger at the defendant saying that: ‘You know what you did.’ The defendant even nodded her head. But what comes as a surprise was that the defendant was found not guilty because the prosecution failed to prove its case beyond a reasonable doubt. This example illustrates the idea of presumption of innocence, and questions whether defendants’ interests can sometimes be overprotected. Knowing that the defendant must have committed a crime, the judge does not necessarily have enough power to convict him/her. After all, the power to prove the case beyond doubt lies on the prosecution’s side, and it is the prosecution’s responsibility to make clarifications on the doubt. Otherwise, the benefit of doubt goes to the defendant. Sentencing is also a way that judges demonstrate their power. With reference to Smith and Natalier (2005: 129), judges have to consider many factors including the seriousness of the offence, previous criminal record of the defendant, the range of penalties applicable, harm caused to the victim, and recent court decisions of similar offences. As observed in the courtroom, the penalties are always similar for cases of the same nature, and magistrates often prefer to obtain assessment reports from probation and parole officers to see if community service orders would be a suitable alternative. It is also noteworthy that a 25% discount of the pe nalty is usually awarded for a defendant entering a guilty plea, as an incentive for the defendant to face the consequence of wrongdoing. Thus, it is shown that judges tend to achieve restorative justice, and they decide appropriate sentences in the aim to reduce the risk of re-offending. Courtroom Languages Language is always a form of demonstrating one’s professional knowledge, while knowledge is related to power. Power relationships can be easily observed by looking into the use of language in the courtroom. The hierarchy of power is most explicitly displayed when lawyers refer to magistrates as ‘Your Honour’ or ‘Your Worship’. During the observation, a defendant entered a guilty plea for a minor offence, but he refused to admit the brief facts. The magistrate told him: ‘If you would like to go for a guilty plea, you must agree to the facts, as they are the essence of the charge’. The defendant explained: ‘I plead guilty just because I don’t want to cause any more trouble’. The magistrate said: ‘But if you don’t admit the facts, we will treat this as not guilty’. The defendant looked confused, said: ‘I agree’. As suggested by Carlen (1976: 54), this demonstrates the way that court proceedings proceed, regardless of the fact that many people are actually unable to understand what is going on, and to participate in what is going on. As a result, it is barely surprising that many defendants feel helpless in the court, especially when they do not have a lawyer representing them. Power is als o displayed when courtroom actors are eliciting information from witnesses. Witnesses are required to answer in response to the particular question, and they are not allowed to suggest other things which they believe to be important (Smith and Natalier, 2005: 129). Personality is commonly seen as being made up off number of attributes which can be defined as vast dimensions on which people vary, such as conscientiousness. Knowing which category we fit into in regards to major personality traits is likely to aid us in our pursuit to reach our personal and professional goals. Many contemporary personality psychologists believe that there are five basic dimensions of personality, often referred to as the â€Å"Big five† personality traits. The five broad personality traits described by the theory are extroversion, agreeableness, openness, conscientiousness, and neurotics, (Genera Cherry, 2014). It has been observed over time that certain personality traits can result in greater success in life on both a personal and professional level. In relation to investment banking, personality traits such as being resilient, charming and flexible have all been shown to align with 2. Analysis and reflection of results My personality test scores (see Table 1 below) show that I am high in extroversion and conscientiousness but low in Neurotics. This result labels me as an individual whose traits include characteristics such as excitability, sociability, talkativeness, assertiveness and high amounts of emotional expressiveness in the extroversion category, and high levels of thoughtfulness, with good impulse control and goal- directed behaviors in the conscientiousness (Costa McCrae, 1999). From both my personal and professional experience, I can see a strong connection between the rats of a extroversion and conscientiousness individual and myself. In the past I have been regarded as social and assertive (almost overpowering), but also a friend who is willing to help others solve their personal problems, all of which are characteristics of extroversion and conscientiousness. I plan on doing this by goal setting using the SMART criteria, and Kola’s experiential learning theory. 2. 3 Goal setting My personal goal is to improve on the core elements of the trait â€Å"conscientiousness†, but rather than trying to increase my depth in this field, I intend to decrease my score on the NEO ‘PIP test over a period of twelve months. By doing so I will score low in all traits except Extroversion, which is where I need to be to excel and match the resonantly of a successful investment banker. By using SMART goals and experiential learning theory (Kola, 1984), I believe that I can set specific, measurable, achievable, relevant and timely goal of decreasing my conscientiousness to a score of below 25 on the NEO ‘PIP test. I aim on doing this by actively implementing a reflective learning method that will decrease amounts of sympathy, compassion and the need to solve issues that don’t directly affect me. I will implement this plan using Kola’s experiential learning theory (Salesman, C. K. , Rider, E. A. (2008). This involves; 1. Time to Kill Racism and Justice collide when the life of a ten-year-old black girl, Tonya Hailey, is shattered by two drunken and remorseless young white men , as they brutally beat and rape her. In John Grisham's novel rape, racism, and justice all prevail throughout the story A Time to Kill. Carl Lee Hailey, the father of the ten-year-old child takes justice into his own hands by murdering his daughters assailants. As his young defense attorney struggles with the law to save his clients life, racism spreads through the streets of Canton. ?She watched as he walked around the tree on her right side, and she stared at him as he stared between her legs. When he lowered his pants she turned to the left and closed her eyes. He was hurting her again.? The two men that had raped the black child, Tonya Hailey, had no respect for the black folks. When they selected their victim they did not care if she was a child, but yet the fact that she was black gave them more reason to take away her rights as a human. This is evident throughout the rape when one of the assailants, Cobb explained; ?...that she was not dead because niggers generally could not be killed by kicking and beating and raping. It took much more, something like a knife or a rope to dispose of a nigger.? (pg.2) After the two intoxicated and remorseless men were done with her, the mostly white town found out about this most inhuman crime. They reacted with shock and horror. ?We picked them up last night for rape.? ?Who'd they rape ?That nigger Hailey-- his daughter.? ?You're kidding! (pg.23) The people of the town could not believe that two of their white people could rape a young child. Not only the fact that she was black, but a ten-year-old child. Later on chaos erupted in the town of Mississippi after the father of the raped girl, Carl Lee Hailey took justice into his own outraged hands and murdered her two assailants. Racial tension in the town was already apparent, and excelled to more violent action against the black community after the murders. The people of the town that were white took several actions in trying to interfere with justice. Their first mission was to try and eliminate Carl Lee Hailey's attorney, Jake Brigance. The reason for their hatred towards him was because he was defending a black man in a racial community. As the trial grew deeper, a number of white towns people joined a group who despised blacks , known as the Kl Klux Klan (KKK). Joining together like this, gave them more power to continue their fight against the blacks and the people involved in the case. For ten days, with burning crosses and the crack of sniper fire spreading through the streets of Clanton, the nation sat spellboun! d as a young defense attorney, Jake Brigance struggles to save his clients life -- and then his own. ?Hello,? answered Prattle. ?Who's this asked the voice. ?Deputy Joe Pintle. To prove this, Jake's main witness was a psychiatrist who had the highest credentials in the state of Mississippi. Until the prosecutor, Mr. Buckley, discredited the psychiatrist. ?Dr. Bass, have you ever been convicted of a felony ?Of course not!? Biography of Tarquin the Proud, Etruscan King of Rome Lucius Tarquinius Superbus (died 495 BCE), or Tarquin the Proud, ruled Rome between 534 and 510 BCE and was the last king the Romans would tolerate. Tarquinius despotic reign earned him the title Superbus (proud, haughty). The flaw in Superbus character- he combined a great deal of ambition with a wealth of family treachery in his background- eventually led to the end of the Etruscan rule over the city of Rome. Superbus was a member of the Tarquin Dynasty, dubbed the Great House of Tarquin by Romes historian Livy, but the spotty, intrigue-riddled reign was hardly a dynasty. The Tarquins were one of several Etruscan chiefs, including the Tarchu, Mastarna, and Porsenna, who in turn usurped Romes throne with little chance to found genuine dynasties. Cicero sketched the Tarquin history in his Republica  as an example of how easily good government could degenerate. In the end, Superbus and all of his family (ironically, including Collatinus) were expelled from Rome. Along with the end of the Etruscan kings of Rome, the power of the Etruscans over Latium weakened. Rome replaced the Etruscan rulers with a Republic. Although there are some who believe there was a gradual transition to the consul system of the Republic, the Fasti Consulares list the annual consuls straight after the end of the regal period. Legacy Classical scholar Agnes Michels and others have suggested that the text Livy, Dionysius, and Cicero used to describe the events of the Tarquin Dynasty has all the earmarks of a classic tragedy, or rather, a trilogy of plays with the moral theme of cupido regni (kingdom of lust). Superbus legacy of court intrigue and scandal led to the end of the Etruscan rule of Rome. It was Tarquin the Prouds son, Tarquinius Sextus, who raped the Roman noblewoman Lucretia. Lucretia was the wife of his cousin Tarquinius Collatinus, and her rape brought about the end of Etruscan rule. Lucretias rape was scandalous on several levels, but it came about because of a drinking party during which her husband and other Tarquins argued over who had the most beautiful wife. Sextus was at that party and, aroused by the discussion, came to the virtuous Lucretias bed and forcibly raped her. Novel Nicholas Nickleby Essay

Mr Squeers is one of Charles Dickens’ very vivid characters and one that plays an important role in the novel Nicholas Nickleby. He is owner and headmaster of Dotheboys Hall which is set in Greta Bridge in Yorkshire. Dotheboys Hall is a boarding school for disabled and illegitimate children. It is an all-boys school and Mr Squeers runs the school with extreme cruelty together with his wife, who is equally cruel. The children are sent there because they are disabled in some way and their families did not want them. Mr Squeers has very cunning ways and his only aims are to benefit himself. His main aim is to make money and he does this very well by being sneaky and taking short-cuts in the keeping of his school. He tries to put as little money as possible to Dotheboys Hall whilst getting as much money out as possible. Another of his objectives is to have the instant obedience that he desires. He wants a school where he has ultimate power over the boys so that when he asks something of them they do it immediately – with no question. He tries to obtain this instant obedience in school by regularly beating the boys with a cane. Mr Squeers sees his school more as a business than a school-learning environment. â€Å"This is our shop, Nickleby†. This quote shows that he is treating the school as a business because his primary objective is to make money. He does not really care about the boys’ education, just as long as he turns over a nice profit. As Mr Squeers is owner of Dotheboys Hall he decides how to teach the boys or not, as the case may be. Mr and Mrs Squeers deeply dislike all of the boys in their school, except their own children. In fact they perceive the boys as â€Å"their natural enemies†. Clearly, if they see the boys like this then they are not fit to run a school but as it is their own school, they can do as they like. Mr and Mrs Squeers both hate the boys. â€Å"The only difference between them is that Mrs Squeers wages war against the boys openly whilst Mr Squeers tries to cover his rascality†. I think Mr Squeers tries to cover his rascality because he knows that he is not treating the boys very well and should not be doing this. However, don’t be fooled! Mr Squeers hates the boys as much as his wife but Mrs Squeers doesn’t really look for an excuse to beat them – she just enjoys doing it. All of the boys at Dotheboys Hall are terrified of Mr and Mrs Squeers and live in fear of the dreaded cane which they both use to mercilessly beat them. At the Hall, the boys don’t get much freedom and think what they are told to think. They dare not argue or answer back to Mr Squeers as they are kept too weak and undernourished. It is clear that the boys are scared of him because of the amount of times and the violent manner in which Mr Squeers uses the cane.
